1 General terms and conditions

These terms and conditions contain the terms and conditions for ordering, delivery and cancellation of Products ordered through the unitedgypsies.fi online shopping service (the “Service”) of UG BREWERY Oy (“UG BREWERY”). In addition to these terms and conditions, the provisions of the Consumer Protection Act apply to the sale of Products.

By ordering products from the Service, the Customer accepts the terms and conditions and undertakes to comply with these terms and conditions. The Service also contains notices and operating instructions that specify these terms and conditions. UG BREWERY reserves the right to change the content of the Service and these terms and conditions. The Customer accepts the changes when using the Service. The terms and conditions in force at any time are available on the UG BREWERY website.

2 Definitions

Consumer Customer or Customer means a natural person over 18 years of age using the Service and ordering Products for their private use.

A mild alcoholic product means an alcoholic product that contains no more than 22% ethyl alcohol by volume.

Product means all products sold by UG BREWERY.

3 Ordering and delivery of products

The Customer can place an order for products in the Service either after registering as a user of the Service or without registering. The order placed is binding on the Customer after he/she has accepted the order and paid for it. The Customer is responsible for the accuracy of the information provided to UG Brewery. UG Brewery is not responsible for any damage or disruption caused to the Customer or a third party due to incorrect information provided by the Customer.

Customers ordering products must be of legal age. UG Brewery sells Mild alcoholic products to persons who are at least 18 years of age.

UG Brewery has the right to cancel an order placed by the Customer if the Customer violates or circumvents the Terms of Service or acts contrary to law or good practice. UG Brewery reserves the right to refuse to sell or deliver Products to the Customer.

UG Brewery is not liable for any damages caused by any disruptions, errors or delays in the processing or delivery of orders that are due to reasons other than the Service. UG Brewery is not liable for damages caused by force majeure or unreasonable difficulties in operations due to similar reasons, such as measures taken by authorities, war or the threat thereof, rebellion or riot, disruptions beyond UG BREWERY's control in the flow of mail, automatic data processing, data transfer, other electronic communications or electricity supply, interruptions caused by fire or other accidents or industrial action, such as strikes, lockouts, boycotts or blockades. Force majeure or other circumstances mentioned above entitle UG Brewery to suspend the delivery of orders until further notice.

The main features and price of each Product or service are stated on the product page. Allergens contained in the product are indicated on the product label. Prices include VAT, unless otherwise stated. The availability of the Product and any restrictions related to availability are also stated at the same time. If there are any delivery difficulties with the ordered Product, UG Brewery will contact the Customer.

UG Brewery reserves the right to set restrictions or conditions regarding the number of Products that can be ordered. UG Brewery reserves the right to set a price cap for Products, above which Products cannot be ordered. The Customer is not entitled to attempt to circumvent the price cap by placing multiple consecutive orders. If the Customer places multiple consecutive orders, all orders will be taken into account in calculating whether the price cap is exceeded for that Customer.

The delivery costs of the product are announced before purchase. The products included in the Service are only delivered within Finland. If the delivery area is otherwise limited, the limitations will be announced in the Service. UG Brewery will deliver the Products to the UG Brewery store agreed upon with the Customer in advance.

4 Payment methods

The Customer pays for the ordered Products at the time of ordering using payment methods accepted by UG Brewery. Payment methods are specified in more detail in the Service.

5 Picking up and handing over products

The Customer may collect the Products from the agreed UG Brewery store. The Products may only be delivered to the Customer during the opening hours of the UG Brewery stores.

The recipient must meet these terms and conditions and other conditions for transfer required by law.

The ordered Products will be delivered to the Customer provided that:

When handing over mild alcoholic products, the person concerned must have reached the age of 18.
the person concerned is not behaving in a disruptive manner and is not clearly intoxicated; or
There is no reasonable basis to assume that an alcoholic beverage has been illegally transferred or distributed. If alcoholic beverages are transported for a fee (e.g. by transport companies or taxis), this constitutes unlawful distribution.
If the recipient is a person other than the subscriber, the order will only be delivered upon receipt of an order confirmation.
The customer's identity is checked upon delivery and UG Brewery records the person's name to prevent and resolve abuse and problem situations, and to ensure data security.

The Customer must collect the Products ordered from the store within 10 days of the arrival notification. If the Consumer Customer does not collect the Products ordered within the aforementioned time frame, UG Brewery may, if it wishes, consider the Consumer Customer to have exercised their right of withdrawal described in section 6 below, after which Alko will refund the price paid for the Products to the Consumer Customer as described in section 6.

The decision on the handover of the Products always lies with the staff of the UG Brewery store handing over the Products.

6 Right of withdrawal and return

The Consumer Customer has a 14-day right of withdrawal in accordance with the Consumer Protection Act. The Consumer Customer must notify UG Brewery of the withdrawal within 14 days of receipt of the Product and the Product must be returned without delay and no later than 14 days after the notification of withdrawal. Cancellation instructions and the available cancellation form have been provided in connection with the order confirmation. Simply returning or not collecting the Product is not enough, but the Consumer Customer must also make a separate notification of withdrawal. If the Consumer Customer does not have the opportunity to print the form, the form can be requested by contacting UG Brewey's customer service.

The consumer customer must also present the order confirmation/receipt of their purchase when returning the Products. The consumer customer can return the Products by bringing them to the UG Brewery store. The consumer customer can also leave the Products to be returned for delivery by post. In this case, the Products must be packaged carefully so that they are not damaged or broken. The consumer customer is responsible for the costs of returning the Products, such as packaging and shipping costs.

The Consumer Customer must keep the Product they have received essentially unchanged and undiminished, otherwise the Consumer Customer will lose their right to return. The Product to be returned must be in saleable condition and the original sales packaging must be clean and complete. An opened Product cannot be returned. The Consumer Customer must return the Products in their original sales packaging. The cardboard transport packaging can be opened.

The price of the Products duly returned will be refunded to the Consumer no later than 14 days after the Consumer Customer has made a cancellation notice and returned the Products to UG Brewery. If the Consumer Customer returns only part of the order, the delivery costs will not be refunded. The money will be refunded using the same payment method that the Consumer Customer used when placing the order.

If the Consumer Customer cancels the order for the Products by giving an express cancellation notice or by not collecting the Products, UG Brewery has the right, at its discretion, to either release the Products in question for sale or, if necessary, destroy the Products.

7 Error messages and limitation of liability

UG Brewery is liable for defects in Products and deliveries in accordance with the Consumer Protection Act. The consumer customer must notify UG Brewery of the defect within a reasonable time so that UG Brewery has the opportunity to correct any defect or otherwise compensate for it. The customer must deliver the defective Product to the UG Brewery store. When reporting a defect in the delivery, the customer is obliged to present the order confirmation/receipt of the order placed. UG Brewery will replace the defective Product or otherwise compensate it.

Error reports must be made in writing. Only written error reports will be processed. Error reports can be submitted by email to myynti@unitedgypsies.fi or by post to UG Brewery Oy, Hemmolankatu 26 b, 08150, Lohja.

Unless otherwise provided for by the mandatory provisions of the Consumer Protection Act, UG Brewery is not liable for any indirect damage caused to the Consumer Customer and UG Brewery's liability for direct damage caused to the Consumer Customer due to a breach of contract is limited to an amount corresponding to the total price of the Products subject to the transaction.

8 Processing of personal data and cookies

Personal data provided by the customer electronically or otherwise will be processed in accordance with the EU General Data Protection Regulation (EU 2016/679) and national legislation.
Personal data about the customer is collected and stored in a customer register maintained by UG Brewery. The use of personal data and cookies is described in the Privacy Policy, which can be viewed on the UG Brewery website.

9 Applicable law and dispute resolution

These order and delivery terms and conditions are governed by Finnish law, excluding its conflict of law provisions.

Disputes arising from and related to these terms and conditions of order and delivery shall primarily be resolved through negotiations between UG Brewery and the Customer. If the negotiations do not lead to an amicable outcome, the dispute shall be resolved in the general court of the Consumer Customer’s place of residence. However, the Consumer Customer always has the right to submit disputes arising from these terms and conditions to the Consumer Disputes Board (www.kuluttajariita.fi). The Consumer Customer may also initiate the resolution of the dispute through the online dispute resolution platform (ODR) (http://ec.europa.eu/odr).
